Introduction

Welcome to Melting Vanilla, an app designed to help couples comfortably communicate their sexual needs, wants, desires, and boundaries. By using Melting Vanilla, you agree to comply with and be bound by the following Terms of Service ("Terms"). These Terms form a legally binding contract between you and Sixty Six East, LLC. (creators of the Melting Vanilla app) and apply to any website, web or mobile application, API, or service (collectively, "Services") offered by Sixty Six East, LLC or its affiliates ("we," "us," "our"). Please read these Terms carefully.

Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these Terms, please do not use our Services.

Eligibility

You must be at least 18 years old to use Melting Vanilla. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. By using the Services, you confirm that:

• You are a legal adult over the age of 18.
• You have the legal capacity to enter into an agreement of these Terms.
• You are not a convicted sex offender.
• You will not use the Services in any way to engage with a minor.
• You reside and will access the Services from the United States, Canada, or their respective territories.
• You will comply with these Terms and all applicable laws and regulations.

You must meet these requirements to use or access the Services.

User Responsibilities

• Accurate Information: You agree to provide accurate and complete information when creating your account and using our Services.
• Confidentiality: You are responsible for maintaining the confidentiality of your account information and any content shared within our Services. Additionally, you are responsible for maintaining the confidentiality of any information shared with you by your paired partners within our Services.
• Respect: You agree to use our Services respectfully.
• Activity: You are responsible for activity in your account and must keep your information (i.e., secret link, password, etc.) confidential. If you believe someone has accessed your account, contact [email protected].

User Content

The Services may allow you to provide content ("user content"). By providing content, you:

• Grant us a worldwide, royalty-free license to use your user content in connection with operating our Services, including copying, distributing, transmitting, editing, modifying, incorporating into other works, or reformatting.
• Warrant that you own the rights to your user content or are authorized to post it.
• Acknowledge that you are solely responsible for your user content.
• Agree that any user content you post will be non-confidential and non-proprietary.
• Assume all risks associated with your user content, including its accuracy, completeness, and appropriateness. We are not responsible for any interactions between you and other users or for any user content posted by you or others.

Please exercise caution when sharing content, as we cannot prevent users from copying or sharing content outside the Services.

Prohibited Activities

• Illegal Activities: You may not use our Services for any illegal activities or in violation of any laws or regulations.
• Harassment: You may not harass, abuse, or harm other users.
• Content Sharing: You may not share information or any content that violates another person's privacy or intellectual property rights.
• Unauthorized Access: You may not use another user's account.
• Automated Access: You may not access the Services through automated means.
• Impersonation: You may not use our Services to impersonate another person.
• Interference: You may not participate in activities aimed at disrupting the Services' functionality.
• Content Theft: You may not steal the content of the Services through manual or automated means.
• Code Extraction: You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of any software unless laws prohibit these restrictions or you have our written permission.

Free for Life Eligibility

Melting Vanilla will be free to use for the lifetime of the Services for the first 100 users who meet the following eligibility requirements:

• Have signed up for an anonymous Melting Vanilla account.
• Have matched at least one sexual fantasy card with their paired partner.

To keep Melting Vanilla anonymous, you do not need to provide identity-revealing information at sign-up. Instead, Melting Vanilla provides you with a unique and secure sign-in URL. This URL is the only way you can return to the app to answer cards and see your matches. Treat this sign-in URL like a password and be sure to store it securely and do not share it with anyone. If you lose this URL, you will not be able to access your account, and you will lose your eligibility for free lifetime access to the Services.

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose your information.

Intellectual Property

Our Services and their entire contents, features, and functionality are owned by Sixty Six East, LLC, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not modify, copy, create derivative works, or use our materials for commercial purposes without permission. Our trademarks and other related names and logos are protected. You must not use them without our permission.

If you believe any part of the Services infringes your copyright, please report it to [email protected].

Monitoring and Account Termination

We reserve the right to monitor, terminate, or suspend your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users. Additionally, we reserve the right to:

• Remove or reject any user content.
• Disclose user content to satisfy legal requirements.

Service Termination

We may add, remove, suspend, or stop the Services at any time without notice.

Indemnity

You agree to indemnify, defend, and hold harmless Sixty Six East, LLC and its affiliates from any claims, damages, or losses arising from your use of the Services, your user content, or your breach of these Terms.

Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components.

We are not responsible for any loss or damage to your device, data, or content resulting from your use of the Services. By using our Services, you may be exposed to offensive or inappropriate content, which we are not responsible for.

Limitation of Liability

To the fullest extent permitted by law, our Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our Services.

You release us from all liability for personal injury, death, or property damage arising from your use of the Services. We are not responsible for acts or omissions of third parties.

Changes to Terms

We may modify these terms at any time. Any changes will be effective immediately upon posting the updated Terms in our Services. Your continued use of our Services after any changes to the Terms will constitute your acceptance of the new terms.

Arbitration, Class-Action Waiver, and Jury Waiver

All disputes will be resolved by binding individual arbitration, except for disputes seeking equitable relief for intellectual property violations. Arbitration will be conducted through the American Arbitration Association.

You and Sixty Six East, LLC waive any right to a jury trial or class action.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

Severability

If any provision is found unenforceable, it will be severed from these Terms and will not affect the validity of the remaining provisions.
